Why You Need a Handbook

An employee handbook is not legally required in California or New York, but it is strongly recommended. It sets clear expectations, documents your policies, and provides critical legal protection. In employment disputes, courts look at whether you had written policies and whether employees were informed of them. Without a handbook, you are exposed.

Required Sections for California

At-will employment statement (conspicuous and clear). Anti-harassment and anti-discrimination policy with complaint procedures. Paid sick leave policy (state minimum plus local requirements). Meal and rest break policy with specific timing rules. Wage and hour policies including overtime rules. Leave policies covering CFRA, PDL, and any local requirements. Workers compensation information. Drug and alcohol policy.

Additional Sections for New York

New York adds several required or recommended handbook sections. Paid family leave policy (up to 12 weeks). NY HERO Act workplace safety information. Reproductive health decision-making anti-discrimination notice. If you have NYC employees: lactation accommodation policy, temporary schedule change policy, and commuter benefits information.

Common Mistakes to Avoid

Do not copy a handbook template from another state - California and New York rules are unique. Do not include policies that contradict state law (such as use-it-or-lose-it PTO in California, which is illegal). Always include an acknowledgment page for employees to sign. Update the handbook annually as laws change. HireStates generates handbooks that are automatically tailored to your specific state and city requirements.
